North Carolina has adopted the federal Hazardous Materials Regulations (HMR), Title 49, Code of Federal Regulations (CFR), Parts 170 – 190, as well as Part 397 of the Federal Motor Carrier Safety Regulations, and amendments thereto, in effect since December 1, 1983. This adoption applies to all motor carrier vehicles engaged in interstate and intrastate movement over the highways of North Carolina.
The North Carolina Department of Public Safety (DPS) and North Carolina State Highway Patrol exercise regulatory control over hazardous material transportation within the state.
The North Carolina Department of Environmental Quality (DEQ), Hazardous Waste Section, regulates hazardous waste and maintains the hazardous waste management program within North Carolina.
