Nebraska has adopted, as law, the federal Hazardous Materials Regulations (HMR), Title 49, Code of Federal Regulations (CFR), Parts 107 Subparts F and G, 171 –173, 177, 178, and 180, as well as Part 397 of the Federal Motor Carrier Safety Regulations. The adoption applies to all motor carriers and drivers of such motor carriers and vehicles — both interstate and intrastate.
The Nebraska State Patrol (NSP), Carrier Enforcement Division, exercises regulatory control over hazardous materials within the state.
The Nebraska Department of Environment and Energy (NDEE) is the lead agency in developing and administering the hazardous waste management program within Nebraska.
