Montana Department of Justice (DOJ) has adopted, as state regulations governing the transportation of hazardous materials by motor carriers or railroad, the federal Hazardous Materials Regulations (HMR), Title 49, Code of Federal Regulations (CFR), Parts 107, 171 – 173, 177, 178, and 180, as well as Parts 382, 385, 387, 390 –399, and Appendix G through Subchapter B of Chapter III of the Federal Motor Carrier Safety Regulations as they were on June 1, 2001 (ARM-23.5.101). The adoption has been in effect since October 1, 2005.
The Montana DOJ and the Montana Department of Transportation (MDT) regulates the transportation of hazardous materials within the state. The Montana Highway Patrol enforce the regulations.
The Department of Environmental Quality (DEQ) is the lead agency in administering the hazardous waste management program within Montana.
