The Montana Department of Transportation (MDT) has adopted, as state regulations governing the transportation of hazardous materials by motor carriers, the federal Hazardous Materials Regulations (HMR), Title 49, Code of Federal Regulations (CFR), Parts 107, 171-173, 177, 178, and 180, as well as applicable Federal Motor Carrier Safety Regulations. The adopted regulations are incorporated by reference and updated periodically through amendments to Montana's administrative rules.

The Montana Department of Transportation (MDT) and the Montana Highway Patrol regulate and enforce the transportation of hazardous materials within the state.

The Department of Environmental Quality (DEQ) is the lead agency in administering the hazardous waste management program within Montana.
