Relationship to Federal Regulations - Minnesota

Minnesota Statutes Section 221.03 adopt the federal Hazardous Materials Regulations (HMR), Title 49, Code of Federal Regulations (CFR), Parts 171 – 199, and within United States Code sections 5101 – 5126, with limited exceptions. No person may transport, offer, or accept hazardous materials for transportation within the state of Minnesota except in compliance with the provisions of the federal laws and/or regulations. The provisions apply to the transportation of hazardous materials via intrastate commerce to the same extent they apply to transportation via interstate commerce. Minnesota has also adopted the Federal Motor Carrier Safety Regulations, Parts 392 and 397, by reference, in Minnesota Statutes 221.0314 for interstate transportation only. The Minnesota Department of Transportation (DOT), Commercial Vehicle Operations (CVO), as well as the Minnesota State Patrol (MSP), Commercial Vehicle Section, regulate the shipping and transportation of hazardous materials, hazardous substances, and hazardous wastes within the state.

The Minnesota Pollution Control Agency (PCA) administers the hazardous waste management program within Minnesota.
