The Hawaii Department of Transportation (DOT) has incorporation by reference the federal Hazardous Materials Regulations (HMR), Title 49, Code of Federal Regulations (CFR), Parts 107, 171 – 173, 177, 178 and 180 as they existed November 10, 2009, as well as Parts 390 – 399 of the Federal Motor Carrier Safety Regulations, as they existed on November 10, 2009. This adoption applies to both intrastate and interstate shipments.
The Hawaii DOT regulates the transportation of hazardous materials within the state.
The Hawaii Department of Health (DOH), Solid and Hazardous Waste Branch, regulates the transportation of hazardous waste within Hawaii.
