The State of Delaware has adopted by reference the federal Hazardous Materials Regulations (HMR), Title 49, Code of Federal Regulations (CFR), Parts 171-180 (excluding 49 CFR §§ 171.15, 175.45, and 177.824(f)), including future amendments. Delaware has also adopted the Federal Motor Carrier Safety Regulations, Parts 390-393 and 395-397, as well as Part 387, for application to interstate and intrastate motor carriers.

The Delaware State Emergency Response Commission (SERC) coordinates hazardous materials emergency planning and implementation of regulations pertaining to extremely hazardous substances within the state. The Department of Natural Resources and Environmental Control (DNREC) implements programs relating to hazardous substances and hazardous waste.

The Department of Natural Resources and Environmental Control (DNREC) is the lead agency in developing and administering the hazardous waste management program within Delaware.
