Delaware has adopted the federal Hazardous Materials Regulations (HMR), Title 49, Code of Federal Regulations (CFR), Parts 171 – 180 (excluding 171.15, 175.45 and 177.824(f)), with future amendments. The Federal Motor Carrier Safety Regulations, Parts 390 – 393 and 395 – 397 were adopted on July 19, 1985, with future amendments. Part 387 was adopted June 28, 2006. All interstate and intrastate carriers are required to comply with these adopted regulations.
The Delaware State Emergency Response Commission (SERC) regulates hazardous materials within the state. The Emergency Response and Strategic Services of the Department of Natural Resources and Environmental Control (DNREC) implements regulations pertaining to extremely hazardous substances.
The DNREC is the lead agency in developing and administering the hazardous waste management program within Delaware.
