The Arizona Department of Transportation (DOT) has adopted the federal Hazardous Materials Regulations (HMR), Title 49, Code of Federal Regulations (CFR), Parts 107, 171 – 173, 177, 178, and 180, amended, revised and printed on October 1, 2005. Sections within the October 1, 1991, edition are authorized for utilization under the transitional provisions of section 171.14 of the October 1, 2005, edition. The Arizona DOT also adopted Part 397 of the Federal Motor Carrier Safety Regulations as amended, revised, and printed on October 1, 2005.
The Arizona DOT issues regulations regarding the transportation of hazardous materials within the state. The Arizona Department of Public Safety (DPS) is responsible for enforcing the regulations.
The Arizona Department of Environmental Quality (ADEQ) is the lead agency in developing and administering the Hazardous Waste Program within Arizona.
Transporters of hazardous waste must comply with 40 CFR Part 263, the Arizona Revised Statutes, and the Arizona Administrative Code.
