Alabama motor carrier rule 17.001 requires each motor carrier engaged in the transportation of explosives, hazardous materials, or hazardous wastes — as defined by the United States Department of Transportation (DOT) — to comply with the United States DOT Transportation regulations governing carriage by public highway of explosives and hazardous materials.
The Department of Public Safety (DPS) has adopted the federal Hazardous Materials Regulations (HMR), Title 49, Code of Federal Regulations (CFR), Parts 107 (Subpart B), 171 – 180, as well as Parts 383 and 390 – 399 of the Federal Motor Carrier Safety Regulations, as they may be amended. These regulations became effective June 27, 1986, and apply to all motor carriers — both interstate and intrastate.
The Alabama DPS exercises regulatory control over the transportation of hazardous materials within the state. The Alabama Department of Environmental Management (ADEM) is the lead agency in developing and administering the Hazardous Waste Program within Alabama.
