Federal regulations
Kentucky has adopted Part 391 of the Federal Regulations with modifications.
Applicability
Part 391 applies to for-hire and private vehicles with a gross vehicle weight rating, gross combination weight rating, gross vehicle weight, or gross combination weight of 10,001 pounds or more, or transporting hazardous materials which require placarding.
Age
Intrastate drivers must be at least 18 years of age except for transporters of hazardous materials and school bus drivers who must be 21.
Driver qualification file
A driver qualification file (Sec. 391.51) is required. There is an exception to the physical qualification requirement. See Physical Qualification below for details.
Operator’s license
License classes are as follows:
Class | Description |
Class A | Combination of vehicles with a gross vehicle weight rating (GVWR) of 26,001 pounds or more, provided the vehicle being towed is in excess of 10,000 pounds GVWR. |
Class B | Any straight truck with two or more axles and a GVWR of 26,001 pounds or more; or |
Any vehicle with two or more axles and a GVWR of 26,001 pounds or more, pulling a vehicle with a GVWR of 10,000 pounds or less; or | |
A single vehicle designed to transport 16 or more passengers (including the driver) if the GVWR is 26,001 pounds or more. | |
Class C | Any vehicle less than 26,001 pounds GVWR: a) transporting hazardous materials for which placarding is required; or b) transporting 16 or more passengers including the driver. |
Class D | Operate all other vehicles (not requiring a class A, B, or C license). |
Class E | Moped only |
Class M | Motorcycle |

Physical qualification
Though Kentucky has adopted the exception to the majority of the Federal Motor Carrier Safety Regulations (FMCSRs) for transportation performed by the federal government, state government, or a political subdivision in §390.3(f)(2), drivers who possess a commercial driver’s license (CDL) must meet the medical examination requirements in Part 391 or possess a valid waiver.
Medical waivers in addition to those allowed in Sec. 391.49 are allowed for drivers exclusively in intrastate commerce. Contact the Kentucky Transportation Cabinet for application procedures.
