Summary of differences between federal and state regulations
On February 4, 2021 Arizona Governor Doug Ducey signed legislation that extends employment protections to pregnant women in the state. The new law specifies that the terms “because of sex” and “on the basis of sex” as used in the discrimination in employment statutes includes, “because of or on the basis of pregnancy or childbirth or related medical conditions.” It also provides that women affected by pregnancy or childbirth or related medical conditions must be treated the same, for all employment-related purposes, as other persons not so affected but similar in their ability or inability to work, including for receipt of benefits under fringe benefit programs. The legislation also provides that an employer may not differentiate wages or compensation for women who are affected by pregnancy, childbirth, or related medical conditions.
