Summary of difference between federal and state regulations
Tennessee has several statutes that cover plant closings. Employers having 50 or more employees must give notice to employees and state government when there is a covered reduction in force of 50 or more employees during any three month period.
Some plant closings or mass layoffs fall under the federal Worker Adjustment and Retraining Notification Act (WARN). Under WARN, employers are required to provide 60 days’ advance notice of covered plant closings and mass layoffs, notify the affected workers or their representatives, and the appropriate governmental units. WARN does not preempt any other federal, state, or local law, or any employer/employee agreement that requires other notification or benefit. Rather, the rights provided by WARN supplement those provided by other federal, state, or local laws.

The provisions of §50-1-602 (a) shall not apply to any reduction in operations which:
Results solely from a labor dispute;
Occurs at a construction site or other temporary workplace; or
Results from seasonal factors, as determined by the rules of the commissioner of labor and workforce development to be customary within the business or industry.
