OSHA 10-hour and 30-hour training - West Virginia

West Virginia is not a state-plan state and therefore follows federal OSHA in most cases regarding worker safety. However, West Virginia state law requires workers and supervisors who work on public projects with a total project cost of $50,000 or more to complete a 10-hour OSHA construction safety training course.

• Each employee must have their OSHA 10-hour training completion card with them on the construction site.
• Any employee who is required to complete the 10-hour program but has not done so will be subject to removal from the work site, if the employee does not provide documentation of having completed such program within 21 days of the date the employee is found to be in noncompliance.
• The state may assess a civil penalty of up to $1,000 in addition to a penalty of $100 per employee for each day of noncompliance.
