New Hampshire is not a state-plan state and therefore follows federal OSHA in most cases regarding worker safety. However, state law does require OSHA-approved 10-hour safety training for construction workers and supervisors on certain public works construction projects.
- The law applies to any person who signs a contract to work on a construction, reconstruction, alteration, remodeling, installation, demolition, maintenance, or repair of any public work or building by a state agency or municipality with a total project cost of $100,000 or more.
- Employees who fail to obtain their OSHA 10-hour safety course completion card after 15 days of starting work will be removed from the job site.
- Employers can face penalties up to $2,500 and a civil penalty of $100 per employee for each day of noncompliance.
