Minnesota incorporates by reference the federal regulations for Non-Hazardous Solid Waste and Recycling; however, the state adds further requirements.
A summary of the additional requirements includes the following:
- A Permitted waste facilities, waste utilization projects, and waste haulers in Minnesota must submit regular reports to the MPCA. This includes open and closed landfills, processing facilities, transfer stations, waste incinerators, and recycling and composting facilities. The reports include data on waste received or transported, amounts and types of waste, areas served, tipping fees, personnel training, and more. Most annual reports are due February 1 for the preceding calendar year, including reports by waste haulers in Greater Minnesota. Composting and recycling facility reports are due March 1. Waste haulers in the Twin Cities metro area report quarterly by February 1 for Q4, May 1 for Q1, August 1 for Q2, and November 1 for Q3.
- Commercial buildings with: Contracts for weekly collection of four or more cubic yards of trash, or One or more businesses classified in sectors 42 to 81 of the North American Industrial Classification System (NAICS code) are required to recycle at least three of the following materials:
- Glass
- Metal
- Plastic
- Paper: office paper, cardboard, newspaper
- Organics: food waste and non-recyclable paper
- Less common materials specific to your business, such as textiles
