California incorporates by reference the federal regulations for Non-Hazardous Solid Waste and Recycling; however, the state adds further requirements.
A summary of the additional requirements includes the following:
- California has a robust recycling infrastructure that manages beverage containers, organic material, electronic waste, carpet, used oil, paint, and mattresses.
- The law also requires businesses and other public entities to recycle as much of the waste they generate as possible. AB 341 (Chesbro, Chapter 476, Statutes of 2011) requires that businesses that generate four cubic yards or more of commercial solid waste (trash) per week or are a multifamily residential dwelling of five units or more must now arrange for recycling services.
- AB 1826 (Chesbro, Chapter 727, Statutes of 2014) requires commercial businesses to arrange for organic waste recycling services if they generate 2 cubic yards of solid waste per week.
- 14 CCR 17032 - within each of the counties in California, the Boards of Supervisors are responsible for local planning and implementation of solid waste management in accordance with Section 66780 with the following exceptions:
- Alameda county
- Merced county
- Santa Clara county
- Ventura county
- Los Angeles county
- 14 CCR Article 5.95 - “Inert Debris” means solid waste and recyclable materials that are source separated or separated for reuse and do not contain hazardous waste (as defined in CCR, Title 22, section 66261.3 et. seq.) or soluble pollutants at concentrations in excess of applicable water quality.
- (1) “Type A inert debris” includes but is not limited to concrete (including fiberglass or steel reinforcing bar embedded in the concrete), fully cured asphalt, crushed glass, fiberglass, asphalt or fiberglass roofing shingles, brick, slag, ceramics, plaster, clay and clay products. Type A inert debris is waste that does not contain soluble pollutants at concentrations in excess of water quality objectives and has not been treated in order to reduce such pollutants. The board, upon consultation with the State Water Resources Control Board, will determine on a case by case basis whether materials not listed in this subdivision qualify as Type A inert debris. The board and the State Water Resources Control Board may consider statewide and site-specific factors in making this determination.
- 14 CCR Chapter 4 Article 3 - Rigid plastic packaging container program: all rigid plastic packaging containers, except a rigid plastic packaging container that is exempt under Section 17946.5 of this Article, sold or offered for sale in California must meet one of the following criteria…
- 14 CCR Chapter 4 Article 4 - Recycled content newsprint: These regulations explain what recycled-content newsprint requirements consumers and suppliers of newsprint must meet, and what procedures consumers and suppliers of newsprint must follow to report and certify recycled-content newsprint use. These regulations only pertain to newsprint use within the state of California.
- 14 CCR Chapter 4 Article 5 - Recycled content trash bag program: These regulations explain the requirements for each manufacturer and wholesaler of trash bags and each supplier of recycled plastic postconsumer material (RPPCM) which is used to manufacture trash bags which are intended for sale or distribution in California. Also included are procedures manufacturers and wholesalers of trash bags and suppliers of recycled plastic postconsumer material (RPPCM) must follow to meet reporting and certification requirements. These regulations pertain to plastic trash bags which are intended for sale or distribution, or which are sold within California to recycled plastic postconsumer material (RPPCM) used to manufacture plastic trash bags which are sold or intended for sale or distribution in California and other plastic products manufactured by a plastic trash bag manufacturer intended for sale in California. You must comply with these regulations if you are:
- (1) A manufacturer or wholesaler of regulated trash bags, or
- (2) A supplier of RPPCM who sells material to a manufacturer of regulated trash bags.
- 14 CCR Chapter 4 Article 6 - At-store recycling program recordkeeping, reporting and measurement: These regulations do not cover retail establishments that do not meet the definition of a store, or bags that are not plastic carryout bags, as defined. The requirements of the At-Store Recycling Program Law apply only to stores as defined in this Article that provide plastic carryout bags to customers at the point-of-sale. These regulations provide guidance to stores subject to the requirements of the At-Store Recycling Program Law (Public Resources Code Sections 42250 et seq.). Under this law, stores, as defined, shall provide at-store recycling opportunities for plastic carryout bags provided to customers by the stores at the point-of-sale, and shall maintain records describing the collection, transport and recycling of plastic bags collected for a minimum of three years.
- 14 CCR Chapter 4 Article 7 - Reusable grocery bags - This Article establishes an administrative certification fee schedule and clarifies administrative procedures related to payments and submittal and resubmittal of proofs of certification to the department as set forth in sections 42281.5, 42282, and 42282.1 of the Public Resources Code. These regulations are designed to facilitate the process by which reusable grocery bag producers provide proof of certification to the department and ensure that the required administrative certification fee sufficiently covers the department's reasonable costs to implement its responsibilities under the law pursuant to Chapter 5.3 (commencing with section 42280), Part 3, Division 30 of the Public Resources Code.
- 14 CCR Chapter 4 Article 8 - Sustainable packaging for the state of California: Food service packaging items included on the List shall satisfy all the following criteria to minimize public health and litter impacts…If a food service packaging manufacturer seeks to add one or more food service packaging items to the List, an application shall be submitted to the department demonstrating that each food service packaging item or group of food service packaging items meets the applicable requirements of Sections 17989.2 through 17989.5.
