Florida incorporates by reference the federal regulations for New Source Review (NSR) Permitting; however, the state adds further requirements.
Florida adds the net air quality improvement requirement. A summary of the additional requirements includes the following:
- Nonattainment areas with approved SIPs
- The committed volatile organic compound (VOC) or nitrogen oxide (NOx) offsets must exceed the increase of VOC or NOx emissions, respectively, from the proposed new facility or modification by a ratio of at least 1.1:1 for marginal ozone nonattainment areas and 1.15:1 for moderate ozone nonattainment areas. For transitional ozone nonattainment areas, the committed VOC offsets must equal or exceed the increase of VOC emissions from the proposed new facility or modification, and NOx offsets are not required.
