Yes. Many motor carriers designate backup drivers, who would be expected to operate a CMV at a moment’s notice. Often, these backup drivers hold other job titles (e.g., manager, warehouse worker, dispatcher). On those days that drivers have been told to be available to operate a CMV, they are performing a safety-sensitive function. When the employee is at home and on call in this way, the act of being available is still a covered activity.
