There are no federal laws requiring an employer to give an employee a second chance after a workplace substance abuse policy is violated. However, some state laws require employers to offer the chance for rehabilitation the first time a substance abuse policy is violated. The opportunity for rehabilitation must be offered in Maine, Minnesota, Rhode Island, and Vermont.
