OSHA provides some specific regulations regarding agricultural operations in 29 CFR Part 1928 including:
- Rollover protective structures for agricultural equipment;
- Test procedures and performance requirements for protective frames and enclosures, as well as for agricultural tractors;
- Information on guarding of farm field equipment, farmstead equipment, cotton gins, etc.;
- Field sanitation; and
- Cadmium.
Part 1928 covers "agricultural operations," which include, but are not limited to, egg farms, poultry farms, livestock grain and feed lot operations, dairy farms, horse farms, hog farms, fish farms, and fur-bearing animal farms.
Grain handling facilities have unique requirements under 29 CFR 1910.272.
Outside of these specific requirements. OSHA would reference back to the applicable standards within 1910 (general industry) or 1926 (construction) for any other additional hazards that may present themselves within the agricultural operation.
The General Duty Clause can also be used to address hazards not covered by these standards. Some standards may overlap and in cases where two similar standards apply but seem to have conflicting nuances, employers should opt for the more stringent (safest) regulation.
