An employee who tests positive for alcohol or illegal drugs could be required to obtain a substance misuse evaluation from a recognized expert and successfully complete the expert’s recommendations in order to maintain employment or be considered for rehire. Some states require employers to offer rehabilitation the first time the employee fails a drug test.
