When a collector fails to perform a DOT return-to-duty and follow-up drug test under direct observation, the test is still valid. According to 40.209, certain procedural problems do not result in the cancellation of a test and do not require corrective action. A failure to directly observe or monitor a collection when required does not result in a canceled test. However, it is important to note that the error may result in enforcement action under DOT agency regulations.
