(Through September 28, 2020) Yes. If the driver does not qualify for one of the short-haul exceptions in 395.1(e), he or she will need to take a 30-minute rest break prior to operating the CMV.
(On and after September 29, 2020) No. If the driver does not qualify for one of the short-haul exceptions in 395.1(e), and the driver has not driven a CMV for eight total hours on that workday, the driver will not need to take a 30-consecutive minute break from driving prior to operating the CMV.On-duty (not driving) time, off-duty time, sleeper-berth time, or any combination of these will satisfy the 30-minute break from eight total hours of driving.
