The Airborne Toxic Control Measure (or ATCM) for Diesel Particulate Matter (PM) states that portable diesel engines rated at 50 horsepower or greater are subject to reporting requirements under 17 CCR 93116. Diesel-fueled portable engines must also:

Use CARB diesel fuel or a verified alternative diesel fuel,
Meet California diesel PM standards,
Abide by scheduled operating compliance dates,
Prohibit the sale of portable diesel engines under certain circumstances, and
Disclose the applicability of the sale of parts.
