When it comes to pre-employment drug testing, the general rule of thumb is the sooner the better, preferably before the person actually begins working for pay. The more time you have to observe the employee at work, the greater the argument that the test is no longer a “pre-employment” test. In some states, that would mean that the test could only be done if alcohol or illegal drug use was suspected.
