If the applicant tests positive on a DOT test, no amount of time will exonerate the driver of the consequences. Many employers have mistakenly thought that they can retest the applicant after a certain amount of time to get a “clean” result and pretend the first pre-employment test never happened. A person who tests positive on any kind of DOT-required test is not permitted to perform a safety-sensitive function for any DOT-regulated employer until the required steps in the DOT return-to-duty process are complete.
