Hazardous waste handlers must answer three questions to determine whether they are subject to LDRs.
- Is the waste you generate, treat, store, or dispose of hazardous waste? See 40 CFR 262.11 for the proper steps for determining if waste is hazardous.
- Does the waste qualify for any exemptions listed at 261.4? Many materials are excluded from the definition of a solid waste, and a material cannot be a hazardous waste if it doesn’t meet the definition of a solid waste.
- If the waste is hazardous, is it destined for land disposal? “Land disposal” is defined at 268.2.
If the waste you handle qualifies as hazardous, doesn’t qualify for exemptions, and is destined for land disposal, then you must comply with the LDR program.
