New Mexico has adopted Part 395 of the Federal Motor Carrier Safety Regulations (FMCSRs), including subsequent amendments.
Part 395 applies to intrastate vehicles with a gross vehicle weight rating, gross combination weight rating, gross vehicle weight, or gross combination weight of 26,001 or more pounds (whichever is greater), and any vehicle transporting hazardous materials requiring placarding.
Exception: The maximum driving and on-duty requirements do not apply to drivers transporting agricultural commodities or farm supplies for agricultural purposes in New Mexico if such transportation is limited to an area within a 100-air mile radius from the source of the commodities or the distribution point for the farm supplies and is conducted during planting and harvesting seasons within New Mexico as determined by the New Mexico Department of Agriculture.
Electronic logging device (ELD)
New Mexico has adopted the electronic logging device (ELD) requirements in Part 395 for intrastate motor carriers and drivers.
