Federal regulations
Iowa has adopted Part 395 of the Federal Regulations with a few exceptions.
Applicability
Part 395 applies to a driver of a commercial motor vehicle with a gross vehicle weight rating of 26,001 pounds or more, or hauling hazardous materials required to be placarded.
100-Mile-Radius Driver — To comply with the recordkeeping requirements for a 100-mile-radius driver, a driver’s report of daily beginning and ending on duty time submitted to the motor carrier at the end of each work week will be acceptable.
Exception — A driver-salesperson for a private carrier, who is not for hire and who is engaged exclusively in intrastate commerce, and for-hire drivers who are engaged exclusively in intrastate commerce and who operate trucks and truck-tractors exclusively for the movement of construction materials and equipment to and from construction projects may drive 12 hours, be on duty 16 hours in a 24-hour period, and be on duty 70 hours in 7 consecutive days or 80 hours in 8 consecutive days.
Exception — A driver who is engaged exclusively in intrastate commerce and who operates a truck or truck-tractor exclusively for the movement of refined oil products may drive 12 hours, be on duty 16 hours in a 24-hour period, and be on duty 70 hours in 7 consecutive days or 80 hours in 8 consecutive days.
Exception — The hours-of-service requirements (Part 395) shall not apply during planting and harvesting season to drivers transporting:
- Agricultural commodities from the source of the agricultural commodities to a location within 150 air-miles from the source;
- Farm supplies from a wholesale or retail distribution point to a farm or other location where farm supplies are intended to be used within a 150 air-mile radius from the distribution point; or
- Farm supplies from a wholesale distribution point to a retail distribution point within a 150 air-mile radius from the wholesale distribution point.
Electronic logging device (ELD)
Iowa has adopted the electronic logging device (ELD) requirements in Part 395 for intrastate motor carriers and drivers.
