Summary of differences between federal and state regulations
Employer defined
“Employer” means any person employing 15 or more employees for each working day in each of 20 or more calendar weeks in the current or preceding calendar year, and any agent of such a person.
Unlawful employment practices
The unlawful employment practices and exemptions are similar to those under the federal Guidelines on Discrimination Because of Sex. For example, the state law includes an exemption for a bona fide occupational qualification. The state statute also provides an exemption for certain religious organizations that give preference to members or to those who subscribe to the beliefs of the organization.
Any person aggrieved may file a complaint within 365 days of the alleged violation. A complaint may otherwise be filed with the EEOC or with any unit of the state government which is a fair-employment-practice agency.
Posting
Each employer, employment agency, and labor organization must post and keep posted in conspicuous places upon its premises a notice provided by the commission setting forth such information as the commission deems appropriate.
