Summary of differences between federal and state regulations
Employers are not required by federal law to give former employees their final paycheck immediately. Some states, however, may require immediate payment or payment within a specific time period.
Wisconsin requires that for voluntary or involuntary termination the final paycheck is due the next regular paycheck date. (WI Statute §109.03(2).)
For migrant workers the final paycheck is due within three days after the termination date. (WI Statute §109.03(1)(b).)
