Summary of differences between federal and state regulations
Employers are not required by federal law to give former employees their final paycheck immediately. Some states, however, may require immediate payment or payment within a specific time period.
South Dakota Codified Laws §60-11-10 requires that for voluntary and involuntary termination the final paycheck is due at the next payday or as soon as the employee returns the employer’s property.
