Summary of differences between federal and state regulations
Polygraph protection
North Dakota does not have state-level polygraph protection requirements. Private-sector employees are provided protection under federal requirements at 29 CFR Part 801.
Polygraph examiners
Polygraph examiners need to be licensed by the North Dakota Attorney General's Office. The qualifications for obtaining a license include that the person must be at least 18 years old; never have been convicted of an offense determined by the Attorney General to affect the ability to serve as an examiner; have an honorable discharge from the armed forces, if served; pass an approved course of formal instruction; and have passed a written examination administered by the Attorney General.
