Summary of differences between federal and state regulations
Polygraph protection
Mississippi does not have state-level polygraph protection requirements. Private-sector employees are provided protection under federal requirements at 29 CFR Part 801. However, the Mississippi Department of Public Safety may require applicants for the Mississippi Highway Safety Patrol to take a polygraph examination.
Polygraph examiners
Polygraph examiners need to be licensed by the state Department of Public Safety Polygraph Board. The qualifications for obtaining a license include that the person must be a U.S. citizen; at least 21 years old; not been convicted of a felony or misdemeanor involving moral turpitude; have met certain educational and work experience requirements; have graduated from an approved polygraph examiner’s course with associated internship; have a surety bond of $5,000.
Only those instruments that record visually, permanently, and simultaneously cardiovascular and respiratory response patterns can be used. Instruments can additionally record other physiological changes.
