Summary of differences between federal and state regulations
Polygraph protection
Polygraph protection provisions apply to employees and prospective employees in the private-sector and in state and local governments. Employers may not require or request as a condition of employment that an applicant or employee take a polygraph examination. These rules do not apply to law enforcement agencies screening candidates for employment as a peace officer or corrections officer.
Polygraph examiners
Polygraph examiners need to be licensed by the Commissioner of Public Safety under Iowa’s Private Investigative Agencies and Security Agents requirements. The qualifications for obtaining a license include that the person must be at least 18 years old, not be a peace officer, have never been convicted of a felony or aggravated misdemeanor, not be addicted to alcohol or a controlled substance, not have a history of violence, be of good moral character (not convicted of a crime involving moral turpitude or other crimes), and provide fingerprints to the Department of Public Safety.
