Summary of differences between federal and state regulations
Federal contractors who receive qualifying contracts on or after September 8, 2009, must participate in the E-Verify Program, using it to verify new employees and existing employees assigned to a federal contract (qualifying federal contractors may choose to verify the entire workforce).
The Arizona Fair and Legal Employment Act and Legal Arizona Workers Act prohibits all businesses from knowingly or intentionally hiring or contracting with an unauthorized alien. The law also requires employers in Arizona to use the E-Verify system to verify the employment authorization of all new employees hired after December 31, 2007. Failure to comply with the law could result in an employer's business license being revoked or suspended. The law also prohibits government contracts from being awarded to businesses not using E-Verify.
