South Dakota has adopted Part 391 of the Federal Motor Carrier Safety Regulations (FMCSRs), as amended through January 1, 2025, with some modifications.
Effective July 1, 2026, South Dakota has adopted Part 391, as amended through January 1, 2026.
Part 391 applies to drivers and motor carriers operating intrastate vehicles and combinations of vehicles with three or more axles or with a gross vehicle weight rating of 26,001 or more pounds, and any size or type of vehicle used to transport hazardous materials requiring placarding.
Effective July 1, 2026, Part 391 applies to drivers and motor carriers operating intrastate vehicles and combinations of vehicles with a gross vehicle weight rating, gross combination weight rating, gross vehicle weight, or gross combination weight of 26,001 or more pounds, and any size or type of vehicle used to transport hazardous materials requiring placarding.

| Physical Exam - Motor Carrier | Intrastate drivers are exempt from the physical requirements of 391.41. Effective July 1, 2026, intrastate drivers must comply with the physical exam requirements. As of this date, the 391.41 exemption no longer applies. |
