Michigan has adopted Part 391 of the Federal Motor Carrier Safety Regulations (FMCSRs), with some modifications.
Part 391 applies to an intrastate vehicle with a gross vehicle weight, gross vehicle weight rating, gross combination weight, or gross combination weight rating of 10,001 pounds or more (whichever is greater), or any size vehicle transporting a placardable amount of hazardous materials.
Utility Exception: The regulations related to driver qualifications do not apply to utility, telephone, and cable television company service employees if those employees are not otherwise being used as regularly employed drivers and are not operating vehicles requiring a commercial driver’s license.
Farm Vehicle Driver Exception: Farm vehicle drivers as defined in 390.5 are not subject to 391.21, 391.23, 391.31, 391.41 to 391.45 to the extent that they require a driver to be medically qualified or examined and to have a medical examiner’s certificate, and the maintenance of files and records.

| Driving Records | A “Non-Account & Individual Record Request” form (BDVR-154) must be completed by any party requesting another individual’s driving record. A driving record may also be obtained online. Driving records are available via the Secretary of State website: https://www.michigan.gov/sos/all-services/driving-record. The fee is:
A subscription service is available to employers, to check the driving records of employees who drive vehicles as part of their employment. This program automatically generates a driving record which is mailed to the subscriber on an annual basis, and whenever a violation, restriction, suspension, or revocation is posted to the record. A fee is charged for an initial driving record for each driver and yearly records thereafter. If a violation is incurred, a fee is charged for the record generated. This program eliminates the need to make separate requests each time a driving record is needed. Note: Subscription records are not certified. | Physical Exam - Motor Carrier | Physical exam and certificate required A person who is not physically qualified to drive under 391.41 may apply for a waiver. A joint application from the driver and motor carrier needs to be made to the Medical Waiver Unit of the Michigan State Police Commercial Vehicle Enforcement Division. |
