Massachusetts has adopted Part 391 of the Federal Motor Carrier Safety Regulations (FMCSRs), with the exception of 391.11(b)(1) for intrastate drivers. The English language and physical qualification requirements also contain special provisions.
Part 391 applies to vehicles having a gross vehicle weight rating, gross vehicle weight, gross combination weight rating, or gross combination weight of 10,001 pounds or more that are used for the transportation of property, and vehicles transporting a placardable amount of hazardous materials.

| English Language | The English language requirement in 391.11(b)(2) applies to intrastate drivers that obtain an initial permit or initial commercial driver’s license after March 9, 2018, and all drivers operating a vehicle used in the transportation of a hazardous material. |
| Driving Records | A company requesting a driver’s record may use the “Request for Personal Information in RMV Records” form (DCU140). The form is available via the Registry of Motor Vehicles website: https://www.mass.gov/doc/request-for-personal-information-in-rmv-records/download. The request may also be completed via the Registry of Motor Vehicles website: https://atlas-myrmv.massdot.state.ma.us/myrmv/_/. The fee is $20.00 for a certified driving record. |
| Physical Exam - Motor Carrier | Physical exam and certificate required Drivers are exempt from 391.49, pertaining to waivers of certain physical defects. Waivers of the provisions of 391.41, 391.43 and 391.45 will be granted by the Registrar of Motor Vehicles. |
