Louisiana has adopted Part 391 of the Federal Motor Carrier Safety Regulations (FMCSRs), revised as of January 1, 2021, and subsequent amendments, with the exception of 391.11(b)(1)for intrastate drivers.
Part 391 applies to all intrastate commercial motor vehicles with a single or combined gross vehicle weight or gross vehicle weight rating over 26,000 pounds, and all vehicles transporting hazardous materials.
Exemption: If a driver has been regularly employed by a motor carrier for a continuous period of no less than three years immediately prior to January 20, 1988, the driver is exempt from complying with 391.21, 391.23, and 391.33.

| Physical Exam - Motor Carrier | Physical exam and certificate required A driver who has been regularly employed as a commercial vehicle operator for at least 24 months prior to March 31, 1992, is exempt from complying with 391.41(b)(1), (2), (3), (4), (5), (10), and (11). The person may remain qualified only as long as the physician determines, during the biennial physical, that the condition has not substantially worsened. The medical examiner’s certificate must state the words “MEDICALLY UNQUALIFIED OUTSIDE LOUISIANA” when a driver is qualified in accordance with the provisions stated above. Effective August 31, 1994, the medical exemption was discontinued for new applicants. |
