Kansas has adopted Part 391 of the Federal Motor Carrier Safety Regulations (FMCSRs), as in effect on October 1, 2018, and as amended on September 30, 2019, with the exception of 391.27(e), 391.47(b)(8), and 391.49(c)(2)(i).
Part 391 applies to vehicles with a gross vehicle weight rating, gross combination weight rating, gross vehicle weight, or gross combination weight of 10,001 pounds or more, or vehicles transporting hazardous materials requiring placarding.
Exception: Private motor carriers domiciled in Kansas operating vehicles with a GVWR, GCWR, GVW, GCW of 10,001 lbs. to 26,000 lbs. are exempt from compliance with Part 391. This exemption does not apply to motor vehicles which are used in the transportation of hazardous materials and required to be placarded

| Physical Exam - Motor Carrier | Physical exam and certificate required Any person failing to meet the physical qualification requirements of 391.41 may be permitted to drive a vehicle if the Kansas Corporation Commission decides that the granting of a waiver is consistent with highway safety and the public interest. |
