Colorado has adopted Part 380 (Special Training Requirements) and Part 391 of the Federal Motor Carrier Safety Regulations (FMCSRs), as in effect on October 1, 2025, with some modifications.
Part 391 applies to a self-propelled or towed vehicle bearing an apportioned plate or having a manufacturer’s gross vehicle weight rating or gross combination rating of at least 16,001 pounds. Part 391 also applies to a vehicle used on a public highway to transport a placardable amount of hazardous materials.
Part 380 applies to drivers who possess a commercial driver’s license (CDL).

| Driving Records | A “Driver Record Requestor Release and Affidavit of Intended Use” form (DR 2489) is required for each CDL record. A “Permission to Release Driver Records to Self or Another Person” form (DR 2559) is required for each non-CDL record. These forms may be obtained via the Department of Revenue website: https://www.colorado.gov/pacific/dmv/forms-number-order The fees are as follows:

| Entry-Level Driver Training | Each employer must ensure each entry-level driver, who first begins operating a commercial motor vehicle requiring a commercial driver’s license under 42-2-404, CRS, receives the training required by 380.503. |
| Physical Exam - Motor Carrier | Physical exam and certificate required Exception: Drivers of intrastate vehicles and combinations of vehicles with a GVWR or GCWR ≤ 26,000 lbs., which do not require a commercial driver’s license to operate, are not subject to Part 391 Subpart E, Physical Qualifications and Examinations. Any person not meeting the physical qualification requirements of Part 391, Subpart E, may apply with the Colorado State Patrol, Motor Carrier Safety Section for a variance/waiver. Carriers subject to the Public Utilities Commission must also contact that agency for driver qualification waiver possibilities |
