South Dakota has adopted 390.21 of the Federal Motor Carrier Safety Regulations (FMCSRs), as amended through January 1, 2025, for intrastate carriers.*

Section 390.21 applies drivers and motor carriers operating intrastate vehicles and combinations of vehicles with three or more axles or with a gross vehicle weight rating of 26,001 or more pounds, and any size or type of vehicle used to transport hazardous materials requiring placarding.

*South Dakota has adopted the USDOT marking regulations in 390.21 for intrastate CMVs. However, the state is not currently enforcing this regulation. Check with the state regarding any changes in this enforcement policy.
