South Dakota has adopted 390.21 of the Federal Motor Carrier Safety Regulations (FMCSRs), as amended through January 1, 2026, for intrastate carriers.*

Section 390.21 applies to drivers and motor carriers operating intrastate vehicles and combinations of vehicles with a gross vehicle weight rating, gross combination weight rating, gross vehicle weight, or gross combination weight of 26,001 or more pounds, and any size or type of vehicle used to transport hazardous materials requiring placarding.

*South Dakota has adopted the USDOT marking regulations in 390.21 for intrastate CMVs. However, the state is not currently enforcing this regulation. Check with the state regarding any changes in this enforcement policy.
