North Dakota has adopted 390.21 of the Federal Motor Carrier Safety Regulations (FMCSRs), and amendments as they occur.*

Section 390.21 applies to intrastate commercial motor vehicles with a gross vehicle weight, gross vehicle weight rating, gross combination weight, and gross combination weight rating of 26,001 pounds or more, or a vehicle used to transport hazardous materials requiring a placard.

*North Dakota has adopted the USDOT marking regulations in 390.21 for intrastate CMVs. However, the state is not currently enforcing this regulation. Check with the state regarding any changes in this enforcement policy.
