Does the requirement in 29 CFR 1910.95(g)(5) for audiometric testing within six months of an employee’s first noise exposure at or above the action level exempt temporary or seasonal workers who are no longer employed at six months?

The noise standard does not include a specific exemption from audiometric testing for temporary or seasonal workers. However, as explained in a March 8, 1983, preamble, OSHA included the time periods for obtaining a baseline audiogram in sections 1910.95(g)(5)(i) and (ii) to exclude seasonal and temporary workers from the audiometric testing program. If a temporary or seasonal employee’s audiometric testing is due after the employee’s term of employment has ended, the employer is not required to establish a baseline audiogram.
