No. If you are hiring a driver to operate a commercial motor vehicle that does not require a commercial driver’s license (CDL), you are not required to request drug and alcohol testing information from the CDL Drug and Alcohol Clearinghouse. If the driver holds a CDL and the carrier has a Part 382 program (and a Clearinghouse account), it is a best practice to request consent to perform a Clearinghouse query on the driver.
Many carriers have this best practice because a driver who has a DOT drug or alcohol violation is prohibited from operating any kind of commercial motor vehicle, including those not requiring a CDL license.
