In the preamble to the final rule, OSHA states that employers are responsible for implementing all provisions under Subpart D for walking-working surfaces they own and don’t own if their employees will be using them. For example, if you rent a warehouse that your employees use, you must inspect the walking-working surfaces (e.g., floors, ladders, etc.) in the warehouse under 1910.22. Other Subpart D requirements would apply as well.
