No, the Safety Performance History rules, primarily found in §391.23, do not affect the files of drivers hired before October 30, 2004, the date the rules were first enforced. These drivers were subject to the former requirements for background checks and driver qualification files. However, if a driver hired before that date leaves your company and later wants to correct or rebut his or her safety performance history, you must comply with the current rules in §391.23.
