No. OSHA’s post-accident regulations could apply to a CMV driver if the accident didn’t involve a CMV crash (perhaps the driver suffered a slip or fall, for example).
After any accident involving a CDL CMV, a DOT-covered employee/driver must be DOT post-accident drug and alcohol tested if DOT criteria are met. OSHA indicates that drug testing under a federal law, such as a U.S. Department of Transportation rule, is permissible.
