Direct deposit provisions - New York
In New York, private employers may not use direct deposit for payroll without the advance written consent of employees. There are exceptions for employees who a) work in a bona fide executive, administrative, or professional capacity whose earnings are greater than $1,300 per week, or b) employees working on a farm not connected with a factory.
For state employees, direct deposit is mandatory for employees hired on or after January 1, 2023. Exemptions may be requested.
