Overview
The Public Service Commission has authority to promulgate safety rules and regulations for motor carriers in the state of West Virginia. The state has substantially adopted Parts 325, 350, 382, 383, and 385-399 as in effect on January 13, 2022. However, there are some additional requirements or modifications. The adoption is effective January 13, 2022.
Applicability
This adoption applies to any self-propelled or towed motor vehicle used on a highway in intrastate and interstate commerce when the vehicle has a gross vehicle weight rating, gross combination weight rating, gross vehicle weight, or gross combination weight of 10,001 pounds or more, or is of any size transporting a placardable amount of hazardous materials.
